General
- The use of this website, the Member only site my.go-healthcare.co.uk ('the sites'), the services tendered and the purchase of any goods and or services ('the services') are governed by these Terms and Conditions.
- 'The sites' are made available and the services offered are provided strictly in accordance with these Terms & Conditions and where appropriate international and local law.
- Your agreement to comply with and be bound by these Terms and Conditions is deemed to occur upon your first use of 'the sites'. If you do not agree to be bound by these Terms and Conditions, you should stop using the 'the sites' immediately.
- Persons under the age of 18 should use 'the sites' only under the supervision of an Adult, payment Information must be provided by or with the permission of the account / card holder.
- By using 'the sites' or purchasing 'the services' you agree to abide by these Terms & Conditions, be bound to them and submit to the jurisdiction of the Scottish Courts.
- No part of this website is intended to constitute a contractual offer capable of acceptance. Your order constitutes a contractual offer and our acceptance of that offer is deemed to occur upon our sending a dispatch email to you indicating that your membership application or order has been accepted.
- 'The sites' and 'the services' are operated by or provided by Go-Healthcare Limited registered in Scotland SC309670 at Caledonian Exchange 19A, Canning Street, Edinburgh, Midlothian, EH3 8HE Scotland its subsidiaries, assigns or successors, hereinafter referred to as Go-Healthcare.
- Where Go-Healthcare have issued documents to you including, but not limited to emails, letters, forms and other documents then these shall state with whom your contractual relationship is with for the provision of the goods or services to which the documents relate.
- The headings used in these Terms and Conditions are for convenience only and shall have no effect upon the interpretation of these Terms and Conditions. Words imparting the singular number shall include the plural and vice versa. References to any gender shall include the other gender.
- Unless the context otherwise requires, each reference in these Terms and Conditions to:
- "writing", and any cognate expression, includes a reference to any communication effected by electronic or facsimile transmission or similar means;
- a statute or a provision of a statute is a reference to that statute or provision as amended or re-enacted at the relevant time;
- "these Terms and Conditions" is a reference to these Terms and Conditions and any Schedules as amended or supplemented at the relevant time;
- a Schedule is a schedule to these Terms and Conditions; and
- a Clause or paragraph is a reference to a Clause of these Terms and Conditions (other than the Schedules) or a paragraph of the relevant Schedule.
- a "Party" or the "Parties" refer to the parties to these Terms and Conditions.
- In the event that one or more of the provisions of these Terms and Conditions are found to be unlawful, invalid or otherwise unenforceable, that / those provisions shall be deemed severed from the remainder of these Terms and Conditions. The remainder of these Terms and Conditions shall be valid and enforceable.
- In the event that any party to these Terms and Conditions fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.
- Except where otherwise agreed in writing and signed by a Director of Go-Healthcare these Terms and Conditions shall be the prevailing terms.
- This agreement may not be assigned, novated or exchanged in any manner without the express written agreement of Go-Healthcare. In the event that the User is a company or similar corporate body then Go-Healthcare reserves the right to terminate the agreement if an exchange of ownership or alteration of more than 1% occurs in the shareholding of the User.
- Go-Healthcare reserves the right to amend these terms at any time, the prevailing terms will be those published from time to time on 'the sites'.
- In the event of any conflict between these Terms and Conditions and any prior versions thereof, the provisions of these Terms and Conditions shall prevail unless it is expressly stated otherwise.
Definitions and Interpretation
- In this Agreement the following terms shall have the following meanings:
- "Account" means collectively the personal information, Payment Information and credentials used by Users to access Paid Content and / or any communications System on 'the sites'
- "Content" means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored on a computer or any other device that appears on or forms part of 'the sites'
- "Direct Debit" means an instruction that a bank account holder gives to Go-Healthcare confirming that Go-Healthcare, its assigns or agents may collect payments directly from his or her bank account. All such instructions are given and accepted under the terms of the United Kingdom Direct Debit Guarantee which applies to all banks and building societies taking part in the direct debit scheme
- "Membership / Member" means a person who has duly completed an application form to become a member of Go-Healthcare and whose membership has been confirmed by Go-Healthcare
- "Notified Day" means a payment date or the nearest available Business Day thereto for the purpose of drawing payment by Direct Debit or Recurring Billing from a debit or credit card
- "Payment Information" means any details required for the purchase of Services from 'the sites'. This includes, but is not limited to, credit / debit card numbers, bank account numbers and sort codes
- "Purchase Information" means collectively any orders, invoices, receipts or similar that may be in hard copy or electronic form
- "Premises" means our place(s) of business published on 'the sites' or our registered address in the United Kingdom
- "Prescription Only Medicine" (POM) means medicines sold or supplied from registered pharmacy and in accordance with a prescription issued by an appropriate practitioner (a doctor, dentist, nurse independent prescriber, pharmacist independent prescriber or supplementary prescriber). The United Kingdom Medicines Act 1968 Section 58 as amended by Regulation(s) refers
- "Recurring Billing" means an instruction that a card account holder gives to Go-Healthcare confirming that Go-Healthcare, its assigns or agents may bill a specified debit or credit card on a recurring basis
- "Service or Services" means collectively any online facilities, tools, services or information that Go-Healthcare makes available through 'the sites' or otherwise, either now or in the future
- "System" means any online communications infrastructure that Go-Healthcare makes available through 'the sites' either now or in the future. This includes, but is not limited to, web-based email, message boards, live chat facilities and email links
- "Terms of Payment" means the terms of payment as described herein
- "User / Users" means any third party that accesses 'the sites' and is not employed by Go-Healthcare and acting in the course of their employment
- "Web Site or website" means 'the sites' that you are currently using
Governing Legislation, Supervision, Personal Data and safety
- Go-Healthcare Limited is registered under no Z2214382 for processing Personal Data in accordance with the provisions of the United Kingdom Data Protection Act 1998
- Medical advice is given by GPs licensed to practise medicine by the UK General Medical Council (GMC).
- Prescription Only medicine is dispensed in accordance with the best practice of and by pharmacists supervised by the Royal Pharmaceutical Society of the United Kingdom and is sold or supplied only from a registered pharmacy and in accordance with a prescription issued by an appropriate practitioner (a doctor, dentist, nurse independent prescriber, pharmacist independent prescriber or supplementary prescriber). The United Kingdom Medicines Act 1968 Section 58 refers, as amended by Regulation(s) refers.
- The confidentiality of your information is of paramount concern to Go-Healthcare:
- To this end, Go-Healthcare fully complies with current Data Protection Legislation and NHS Medical Confidentiality Guidelines. Patient data is highly secure.
- The medical database is only accessible by Go-Healthcare medical staff and uses levels of security higher than those used in Internet banking.
- Information submitted to Go-Healthcare over the 'My Go Healthcare' website is protected by the strongest industry standard security.
- Other than as described in iii. above information submitted to Go-Healthcare over 'the sites' is normally unprotected until it Go-Healthcare.
- Use of information:
- Go-Healthcare does not collect information about individuals, except where this is specifically stated.
- Go-Healthcare collates non-specific visitor information by methods including analytics.
- Go-Healthcare also use 'cookies' which are alphanumeric identifiers that are stored by your web browser on your computer's hard-drive that enable our system to recognise you when you visit the site. This helps Go-Healthcare track basic visitor information in order that we can better tailor 'the sites' to our visitors' needs.
- Go-Healthcare takes governance and compliance with legislation, best practice and the bodies who govern Go-Healthcare's operations seriously. Go-Healthcare appreciates the concerns of both the public and its members and welcomes comments which should be addressed to The Medical Director Go-Healthcare at the registered office described in 7. above.
- Your Privacy is important to Go-Healthcare, use of the Web Site is governed by our Privacy Policy which can be found at the foot of each page of 'the sites'
Intellectual Property
- All Content included on 'the sites', unless uploaded by Users, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of Go-Healthcare, our affiliates or others. You acknowledge that such material is protected by applicable United Kingdom and International law.
- You may not reproduce, copy, distribute, store or in any other fashion re-use content from 'the sites' unless given express written permission to do so by Go-Healthcare.
- All Intellectual Property rights including, but not limited to, Copyright and Trademarks, in product images and descriptions belong to their respective owners.
- Material from the 'the sites' may be re-used without written permission where any of the exceptions detailed in Chapter III of the United Kingdom Copyright Designs and Patents Act 1988 apply.
Links to other Websites and User Content
- 'The sites' may contain links to other sites. Unless expressly stated, these sites are not under the control of Go-Healthcare or that of Go-Healthcare's affiliates. Go-Healthcare assumes no responsibility for the content of such websites and disclaims any liability for loss or damage arising out of the use of them. The inclusion of a link to another site on this Web Site does not imply any endorsement of the sites themselves, any opinion expressed thereon or of those in control of them.
- Go-Healthcare assumes no responsibility for the content uploaded by Users and disclaims any liability for loss or damage arising out of the use of such content. Any opinion expressed in content uploaded by Users is not necessarily, if at all, the opinion of Go-Healthcare.
Use of 'the sites'
- When using the enquiry form or any other System on the Web Site you should do so in accordance with the following rules:
- You must not use obscene or vulgar language;
- You must not submit Content that is unlawful or otherwise objectionable. This includes, but is not limited to, Content that is abusive, threatening, harassing, defamatory, ageist, sexist or racist;
- You must not submit Content that is intended to promote or incite violence;
- It is advised that submissions are made using the English language(s) as we may be unable to respond to enquiries submitted in any other languages;
- The means by which you identify yourself must not violate these terms of use or any applicable laws;
- You must not impersonate other people, particularly employees and representatives of Go-Healthcare or our affiliates; and
- You must not use our System for unauthorised mass-communication such as "spam" or "junk mail".
- You acknowledge that Go-Healthcare reserves the right to monitor any and all communications made to us or using our System.
- In order to procure Services on 'the sites' and to use the facilities you are required to create an Account, which will contain certain personal details, and Payment Information that may vary based upon your use of 'the sites' as we may not require payment information until you wish to make a purchase. By continuing to use this Website you represent and warrant that:
- all information you submit is accurate and truthful;
- you have permission to submit Payment Information where permission may be required; and
- you will keep this information accurate and up-to-date.
- Your creation of an Account is further affirmation of your representation and warranty.
- It is recommended that you do not share your Account details, particularly your username and password. Go-Healthcare accepts no liability for any losses or damages incurred as a result of your Account details being shared by your actions or lack thereof. If you use a shared computer, it is recommended that you do not save your Account details in your internet browser.
- If you have reason to believe that your Account details have been obtained by another without consent, you should contact Go-Healthcare immediately to suspend your Account and cancel any unauthorised orders or payments that may be pending. Please be aware that orders or payments can only be cancelled up until provision of Services has commenced. In the event that an unauthorised provision commences prior to your notifying us of the unauthorised nature of the order or payment, Go-Healthcare accepts no liability or responsibility and you should make contact with the third party service provider detailed in the Purchase Information OR Go-Healthcare will suspend provision of Services and the withdrawal of any scheduled payments pending investigation. Following investigation, it shall be determined whether or not to cancel the Services and make a full or partial refund of the payment. Any decision made by Go-Healthcare shall be final and binding.
- When choosing your username you are required to adhere to the terms set out above. Any failure to do so could result in the suspension and/or deletion of your Account.
- Either Go-Healthcare or you may terminate your Account. If Go-Healthcare terminates your Account, you will be notified by email and an explanation for the termination will be provided. Notwithstanding the foregoing, we reserve the right to terminate without giving reasons.
- If Go-Healthcare terminates your Account, any current or pending orders or payments on your Account will be cancelled and provision of Services will cease.
- The Service is provided "as is" and on an "as available" basis. We give no warranty that the Service will be free of defects and / or faults. To the maximum extent permitted by law we provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality.
- Go-Healthcare does not represent or warrant that such Services will be available. Availability indications are not provided on the Web Site.
- Go-Healthcare accepts no liability for any disruption or non-availability of 'the sites' resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.
Provision of Services
- The services to be provided by Go-Healthcare are described hereunder in "Schedule of Description of Services and Associated Conditions of Use"
- Go-Healthcare, its servants and agents shall use their best endeavours to provide the Services with reasonable skill and care.
- Provision of all Services shall be subject to the terms and conditions pertaining directly to those Services.
- In the event that Services provided to you are not in conformity with your order and thus incorrect, you should contact us within ten days. Go-Healthcare will ensure that any necessary corrections to the Services provided are made within seven working days.
- If the Member wishes to vary any details of the Service he has contracted to receive he must notify Go-Healthcare in writing as soon as possible. Go-Healthcare shall only make changes at its absolute discretion, any reasonable additional costs thereby incurred shall be invoiced to the Member and the Member hereby agrees to pay them.
- Go-Healthcare makes no warranty or representation that the Website will meet your requirements, that it will be of satisfactory quality, that it will be fit for a particular purpose, that it will not infringe the rights of third parties, that it will be compatible with all systems, that it will be secure and that all information provided will be accurate. We make no guarantee of any specific results from the use of our Service or Services.
- No part of 'the sites' are intended to constitute advice and the Content of 'the sites' should not be relied upon when making any decisions or taking any action of any kind.
- No part of 'the sites' are intended to constitute a contractual offer capable of acceptance.
- With effect from the Commencement Date (Date of Joining) Go-Healthcare shall, in consideration of the Fees being paid in accordance with the Terms of Payment provide the Services to the Member.
- Go-Healthcare will use reasonable care and skill to perform the Services.
- Go-Healthcare shall use all reasonable endeavours to complete its obligations under these Terms and Conditions, but time will not be of the essence in the performance of these obligations. If, due to circumstances beyond Go-Healthcare's control, it has to make any change in the arrangements relating to the provision of the Services it shall notify the Member immediately. Go-Healthcare shall endeavour to keep such changes to a minimum and shall seek to offer the Member arrangements as close to the original as is reasonably possible in the circumstances.
- The Client agrees to make reasonable use of the Service and in accordance with the Schedule of Services as set out below.
- Go-Healthcare reserves the right to exercise discretion with respect to any alterations to Services. Factors which may be taken into account in the exercise of this discretion include, but are not limited to:
- Any use or enjoyment that you may have already derived from the Services;
- Any characteristics of the Services which may mean that cessation of provision is impossible without significant further work on the part and at the expense of Go-Healthcare
Such discretion to be exercised only within the confines of the law.
- If Go-Healthcare fails to perform the Services with reasonable care and skill it will carry out remedial action at no extra cost to the Member.
- Go-Healthcare shall be under no liability if it is unable to carry out the provisions of any contract for any reason beyond its control including (without limiting the foregoing) Act of God, Legislation, insolvency of supplier, wars, fire, flood, drought, failure of power supply, Internet Service Provider failure, mechanical breakdown, lock out, strike or other action taken in contemplation of furtherance of a dispute or owing to any inability to procure goods for the performance of the contract. During the continuance of such a contingency the Member may by written notice to Go-Healthcare elect to terminate the Contract and pay any charges due in accordance with these Terms and Conditions.
- To the maximum extent permitted by law, Go-Healthcare accepts no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the Website or any information contained therein. Users should be aware that they use the Website and its Content at their own risk.
- Nothing in these Terms and Conditions excludes or restricts Go-Healthcare's liability for death or personal injury resulting from any negligence on the part of Go-Healthcare.
- Nothing in these Terms and Conditions excludes or restricts Go-Healthcare's liability for any direct or indirect loss or damage arising out of the incorrect provision of Services or out of reliance on incorrect information included on 'the sites'.
- Whilst every effort has been made to ensure that these terms and conditions adhere strictly with the relevant provisions of the United Kingdom Unfair Contract Terms Act 1977, in the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these terms and conditions and shall not affect the validity and enforceability of the remaining terms and conditions. This term shall apply only within jurisdictions where a particular term is illegal.
Membership
- Upon being conferred the rights of Membership the following shall apply:
- Cancellations - you can cancel your membership at any time by giving Go-Healthcare one month's written notice, either by e-mailing the members department through the Contact section of 'the sites' including "Cancellation" as the first word of the text of your email or by post to: Go-Healthcare, 8 St Peter's Court, Bradwell on Sea, Essex CM0 7JE.
- One month from receipt of your cancellation request the telephone advice service will cease.
- However for best practice relating to the disposal of prescribed medicines, these need to be returned to Go Healthcare or the pharmacy whose address will be advised to you on receipt of our cancellation notice. Until these are received by Go-Healthcare or its agents you will remain a member and be bound by these Terms and Conditions including remaining liable for payments due under the terms of your membership.
- Refunds – other than provided herein, refunds are only made in the following circumstances and will be refunded within 28 days of us being aware of it:
- In the event of overpayment
- The death of a member
Please e-mail the members department through the Contact section of 'the sites' including "Overpayment" as the first word of the text of your email or by post to: Go-Healthcare, 8 St Peter's Court, Bradwell on Sea, Essex CM0 7JE.
- Go-Healthcare reserves the right to cancel orders or payments without stating reasons, for any reason prior to processing payment or commencing Services provision.
- If orders or payments are cancelled for any reason prior to commencement of Services provision you will be refunded any monies paid in relation to those purchases.
- If you terminate your Account any non-completed orders or payments will be cancelled and you will be refunded any monies paid in relation to those orders.
- If the User or Member ceases to pay his debts in the ordinary course of business or cannot pay his debts as they become due or being a company is deemed to be unable to pay its debts as they become due or has a winding up petition issued against it or being a Person commits an act of bankruptcy or has a bankruptcy petition issued against him , Go-Healthcare may without prejudice to other remedies shall immediately consider the Customer as in default and in breach of these Terms and Conditions
Fees, Charges and Terms of Payment
- All fees and charges for goods and services supplied by Go-Healthcare shall be paid for in accord with these terms:
- Memberships – are payable in accordance with any schedule supplied to you at the time of your being conferred with Member status and shall be paid monthly in advance payable either by Direct Debit or Recurring Billing
- Goods and other services purchased from our online shop – orders will only be accepted once payment is made either by Credit or Debit Card through a payment gateway on 'the sites'
- The Member agrees to pay the Fees in accordance with the terms hereof.
- In addition Go-Healthcare shall be entitled to recover from the Member its reasonable incidental expenses for materials used and for third party goods and services supplied in connection with the provision of the Services.
- The Member will pay Go-Healthcare for any additional services provided that are not specified herein in accordance with the Go-Healthcare's then current, applicable daily rate in effect at the time of the performance or such other rate as may be agreed. Any charge for additional services will be supplemental to the amounts that may be due for expenses. Whilst every effort has been made to ensure that all descriptions of Services available from Go-Healthcare correspond to the actual Services, Go-Healthcare is not responsible for any variations from these descriptions. This does not exclude Go-Healthcare's liability for mistakes due to negligence and refers only to variations of the correct Services, not different Services altogether.
- All pricing information on 'the sites' is correct at the time of going online. Go-Healthcare reserves the right to change prices and alter or remove any special offers from time to time and as necessary. Where changes of prices or pricing policy are deemed necessary and affect Services 'in contract' Members will be given a minimum of seven calendar days written notice.
- In the event that prices are changed during the period between an order being placed for Services and Go-Healthcare processing that order and taking payment, you will be contacted prior to your order being processed with details of the new price.
- All prices on 'the sites' are inclusive of local taxes, Go-Healthcare reserves the right to alter the prices to reflect the position in relation to Go-Healthcare meeting its obligations under local taxation legislation.
- Provision of Services shall commence when full payment has been received or as otherwise detailed in the Terms & Conditions pertaining directly to those Services.
Notices
- All notices / communications shall be given to us in writing either by post to our Registered Office in 7. above or by email to the customer services department through the Contact section of 'the sites'. Such notice will be deemed received three days after posting if sent in the United Kingdom by first class post, or otherwise within ten days of posting by air mail, on the day of sending if the email is received in full on a business day and on the next business day if the email is sent on a weekend or public holiday.
- All notices given to a Member or User under these Terms and Conditions shall be and be deemed duly given if addressed to the most recent address, e-mail address, or facsimile number notified to Go-Healthcare.
- Service of any document for the purposes of any legal proceedings concerning or arising out of these Terms and Conditions shall be effected by either Party by causing such document to be delivered to the other Party at its registered or principal office, or to such other address as may be notified to one Party by the other Party in writing from time to time.
Termination
- Notwithstanding the provisions hereof Go-Healthcare may terminate the agreement immediately if:
- the Client fails to pay any agreed due sums within seven calendar days of the date due
- the Client is considered by the Supplier to be in breach of their obligations contained as set out the Schedule of Services
- any circumstances whatsoever beyond the reasonable control of Go-Healthcare (including but not limited to the termination of the service through no fault of Go-Healthcare) arise that necessitate for whatever reason the termination of the provision of services.
- In the event of termination as above Go-Healthcare shall retain any sums already paid to it by the Member without prejudice to any other rights that Go-Healthcare may have whether at law or otherwise.
Waiver
- No waiver by Go-Healthcare of any breach of these Terms and Conditions by the Member shall be considered as a waiver of any subsequent breach of the same or any other provision. A waiver of any term, provision or condition of these Terms and Conditions shall be effective only if given in writing and signed by a Director of Go-Healthcare and then only in the instance and for the purpose for which the waiver is given.
- No failure or delay on the part of any Party in exercising any right, power or privilege under these Terms and Conditions shall operate as a waiver of, nor shall any single or partial exercise of any such right, power or privilege preclude, any other or further exercise of any other right, power or privilege.
Schedule of Description of Services and Associated Conditions of Use
- Provision of Medical Advice to Members by General Medical Council Registered General Practitioners on minor illness by use of the telephone, internet or email.
- There will be no provision for Medical Advice on long term or chronic conditions either arising or pre-existing.
- There will be no provision for Medical Advice or treatment for anyone who is not registered as a Member.
- There shall be no provision for face-to-face consultations or visits of any nature.
- Provision of suitable and appropriate prescription-only medication and non-prescription medication to each Member for use solely by that Member.
- The Prescription-only medications must be used or taken only when the Member has been specifically advised to do so as part of a consultation with a General Practitioner (GP) approved by Go-Healthcare and evidenced by the Member if requested to do so by Go-Healthcare.
- Prescription-only medication will be marked with an appropriate label.
- Any issued non-prescription medication can be used by the Member without the need for an accompanying consultation with a GP approved by Go-Healthcare.
- Prescription-only medication when used in accordance with this agreement will be replaced by Go-Healthcare free of charge to the Member.
- If any medication issued to the Member by the Go-Healthcare is lost or stolen or accidentally destroyed or rendered unusable it may be replaced at the Go-Healthcare's absolute discretion and Go-Healthcare may make reasonable charges to the Member for the supply of any replacement medication.
- A record of all supplied prescription-only medication use-by dates and batch numbers will be maintained by Go-Healthcare. Go-Healthcare will notify the Member when any such medication needs replaced and will issue a suitable replacement free of charge. The Member will be responsible for safe disposal of any out of date medication and agrees to dispose of it immediately after it is replaced and in the agreed manner as contained in the instructions placed within the box or published on the Go-Healthcare's website.
- The Member agrees to keep Go-Healthcare up to date on any changes to their current medical conditions, regular medication or other medication being taken or used, allergies of any nature or any other relevant medical information.
- When membership is terminated or ended through any means listed in these terms and conditions, or otherwise, members undertake to either return the prescription only medication to Go-Healthcare at 8 St Peter's Court, Bradwell on Sea, Essex CM0 7JE, OR evidence to Go-Healthcare that they have disposed of the prescription only medicines in an approved way, as listed in the Go-Healthcare Members Handbook. Monthly membership fees cannot be cancelled until the prescription medication is dealt with by either of these means. The right to telephone advice will cease immediately but monthly fees will continue to be taken until this is done.
- Go-Healthcare agrees to maintain Member confidentiality in accordance with the same principles of existing NHS policies and in accordance with the United Kingdom Data Protection Act 1998.
- Go-Healthcare agrees that no medical or other confidential Client information will be shared with any third party or released to anyone without the specific written agreement and permission of the Member.
- In line with existing principles of good medical practice as set out by the General Medical Council of the UK, Go-Healthcare will, unless specifically instructed otherwise by the Member, inform the Member's existing NHS GP (or equivalent) of any care or advice given to them by Go-Healthcare.
